At Right Price Flooring, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to:
A repair, replacement, or refund for a major failure, and
Compensation for any other reasonably foreseeable loss or damage
A repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure
These rights are in addition to any manufacturer warranties or service guarantees we may offer.
Statutory Rights Under the Competition and Consumer Act 2010 (Cth)
When you purchase products or services from Right Price Flooring, you are automatically protected by consumer guarantees under the Competition and Consumer Act 2010 (Cth).
These include:
Goods Must:
Be of acceptable quality
Be fit for purpose
Match any description, sample, or model
Services Must:
Be provided with due care and skill
Be fit for the purpose discussed
Be supplied within a reasonable time, if no timeframe is agreed
What Is Considered a Major Failure?
A major failure occurs when a product or service:
Has a problem that would have stopped someone from buying it if they had known in advance
Is significantly different from a description, sample, or demonstration model
Is substantially unfit for its normal purpose and can’t easily be fixed
Is unsafe
If a major failure occurs, you have the right to:
Reject the product and choose a refund or replacement, or
Keep the product and request compensation for loss in value
If the failure is minor, we are entitled to offer a free repair within a reasonable timeframe.
Additional Warranties (if applicable)
In some cases, you may also benefit from voluntary manufacturer warranties, extended coverage, or service plans. These operate alongside your statutory rights and do not replace them.
You may choose to make a claim under:
Your rights under Australian Consumer Law, or
Any applicable express warranty from Right Price Flooring or the manufacturer
Products Supplied by Third Parties
If the product or service was supplied by a third-party manufacturer or subcontractor, your consumer guarantees still apply. However, additional express warranties may only be available through the original manufacturer and not Right Price Flooring directly.
Dealing with the Manufacturer
If you experience an issue:
We are responsible for resolving the problem — not the manufacturer
Under the Australian Consumer Law, the business that sold you the product must provide a remedy
If we need to send the product to the manufacturer for testing, we will:
Inform you of how long the process will take
Share all details you provided with the manufacturer
Provide any assessment results received from the manufacturer
We reserve the right to assess or inspect the product before offering a remedy.
When You Are Not Entitled to a Remedy
Under ACL, you are not entitled to a refund, repair, or replacement if:
You changed your mind
You found the product cheaper elsewhere
You decided you no longer wanted or needed the item
The problem was caused by misuse, neglect, or failure to follow care instructions
You were informed of the product's issue before purchase (e.g. clearance or damaged goods)
You requested installation or services be carried out in a way that contradicts professional advice
The problem was caused by someone else’s actions (e.g. another tradesperson or installer)
If we offer a change-of-mind return option, it will be clearly stated and honored according to our policy.
